TERMS OF SERVICE

Agreement to Terms

By accessing and using Move Fly Soar coaching services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, you should not use our services.

Description of Services

Move Fly Soar provides personal training and coaching services including:

• Personalized running training programs
• Swimming technique and endurance coaching
• Triathlon preparation and race strategy
• Week-by-week training plan development
• Progress monitoring and program adjustments
• Educational content and technique guidance

Client Responsibilities

As a client, you agree to:

• Provide accurate information about your fitness level, health status, and goals
• Follow safety guidelines and use proper equipment during training
• Communicate regularly about your progress, concerns, or schedule changes
• Make timely payments for services as agreed upon
• Respect scheduling and provide reasonable notice for cancellations

Health and Safety

Medical Clearance: You should consult with your physician before beginning any exercise program. You represent that you are in good physical condition and have no medical conditions that would prevent safe participation in athletic training.

Assumption of Risk: You understand that physical exercise involves inherent risks including but not limited to injury, disability, or death. You voluntarily assume all risks associated with participation in training programs.

Payment Terms

Fees and Billing

• Coaching fees are determined based on the selected program and duration
• Payment is processed securely through Stripe
• All fees are due in advance unless otherwise agreed upon in writing
• Prices are subject to change with 30 days notice to existing clients

Refund Policy

• New clients: Full refund available within 7 days of program start
• Monthly programs: Partial refunds calculated on unused training time
• Completed programs: No refunds for completed coaching services
• Refunds are processed within 5-10 business days through the original payment method

Cancellation and Rescheduling

Session Cancellations

• 24-hour notice: Required for session cancellations or rescheduling
• Emergency cancellations: Accepted with coach discretion
• No-show policy: Sessions missed without notice are forfeited

Program Termination

Either party may terminate the coaching relationship with 14 days written notice. Upon termination, you will receive a pro-rated refund for unused prepaid services.

Intellectual Property

All training programs, materials, and content provided by Move Fly Soar are proprietary and protected by copyright. You may use these materials solely for your personal training and may not redistribute, sell, or share them without written permission.

Privacy and Confidentiality

We are committed to protecting your privacy as outlined in our Privacy Policy. Your personal information and training data will be kept confidential and used only to provide coaching services.

Limitation of Liability

To the fullest extent permitted by law, Move Fly Soar and its coach(es) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of our services.

Our total liability for any claims arising from your use of our services shall not exceed the amount paid by you for services in the three months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Move Fly Soar, its coaches, and affiliates from any claims, damages, losses, or expenses arising from your use of our services or breach of these terms.

Communications

By using our services, you consent to receive communications from us via email, phone, or text message for service-related purposes. You may opt out of non-essential communications at any time.

Modifications

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the updated terms.

Governing Law

These Terms of Service are governed by the laws of the state where Move Fly Soar operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Severability: If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.
